Claire McClain Cissell, Marcy Dodds Magee, and Natalie Bursi in Lewis Thomason’s Memphis office represented a gynecologist in a recent medical malpractice trial. The Plaintiff alleged, among other things, lack of informed consent. The trial lasted two weeks and involved four expert witnesses and several fact witnesses. At the close of Plaintiff’s proof, the Court granted directed verdict to the Defendant as to Plaintiff’s claims for medical battery, negligence per se, loss of earnings and earning capacity, and punitive damages. The jury deliberated for less than five hours and returned a verdict for the Defendant, finding that the doctor had acted in accordance with the recognized standard of acceptable professional practice in obtaining informed consent from the patient.
